1. Collecting information about you and use of collected information

1.      Visiting our website

a)      Which personal data are collected?

You can visit the website of the company Fair wind d.o.o. without any commitment to revealing your identity or leaving any kind of your personal data. The following data, which are automatically collected during each visit to the website are not considered to be personal data: type of your web browser, domain name, time of access, address of the website you came from and information about the pages you visited on our website, as well as actions you made during your browsing our website. These data are collected with the help of so-called cookies. Cookies are pieces of information stored on a user’s hard drive for record-keeping purposes. A cookie cannot determine your name, email address, phone number or any other personal information about you, unless you choose to provide that information. Certain data (but not personal data) are also saved in cookies in your web browser.

 Website of the company Fair wind d.o.o. uses Google Analytics to analyse the use of the website. Google Analytics uses cookies to track the visitor's behaviour and experience of the website. This information generated by the cookie about your use of the website is transmitted to Google. This information is then used to evaluate visitor's use of the website and for the compilation of statistical reports on website activity for the purposes of the company Fair wind d.o.o. b)      What do we use data for?

We use these data for keeping our statistics about the use of the page so that we could improve the quality of our site. We are pointing out that we do not collect your email address or any other information, which could be personally identifiable.

c)      Where and for how long are data stored?

These data are stored with Google for as long as we choose them to be, and we have chosen the 38 months period in order to be able to make the quality long-term statistical reports. The Google policy on data retention can be found here.

d)      Who do we share data with?

Apart from the company Fair Wind d.o.o., these data are available to Google. As a Data Processor, Google provided a data processing agreement which is available on their own Privacy Compliance website.  Furthermore, you can prohibit Google from collecting and analyzing the cookie-generated data about your use of the website by installing the browser plugin provided on this link.

2. Sending booking enquiry via the online form

a)     Which personal data are collected?

By filling and sending booking enquiry via online booking form at http://croatia-charter.hr/booking, following data about you are collected automatically: time of submitting the for and web browser used to reach the page while the other data such as name and surname, email address, phone number, number of people to be on your charter, selected boat and date, number of weeks,  charter option and your message,  you send by your own discretion.

b)     What do we use these data for?

We use these data in order to send you the offer for our services requested in the enquiry.

c)      Where and for how long are data stored?

These data are stored on the server of our web – hosting service provider and on our office computer for as long as it is needed to maintain contact with you with regard to your enquiry.

d)     Who do we share data with?

We use a third-party web – hosting service provider, CloudAccess.net. As a Data Processor, CloudAccess.net provided a data processing agreement which is available here.

 

3. Completing a reservation

a)     Which personal data are collected?

When you decide to complete your reservation, we will need the following personal information: name and surname, address, contact phone, email address, sailing and VHF radio licenses. We are collecting only the information that we need to complete the procedure of reservation of our services.

By placing the reservation you also agree that prior to check-in or at check-in you will need to present your personal identification documents, i.e. submit your personal data (first and last name, type and number of your personal identification document, sex, state and address of residence, with date of birth and citizenship), all for registry of tourists in the Croatian National Tourist Information System – eVisitor (Sojourn Tax Act, Official Gazette “Narodne novine” 152/08). These data are collected for statistic processing and are used by tourist boards, public authorities and ministries relating to this procedure (Ministry of Tourism and tourist inspections, Ministry of Internal Affairs and Ministry of Finances – Customs authorities).

b)     What do we use data for?

We use the data listed above to provide you with the service you ordered. It is necessary that you are informed in a timely manner about all actions and activities related to that service. In order to do that, we contact you by phone only if we believe that it is at your best interest that the information reaches you as soon as possible, and we send all other information related to your inquiry or booking by email: payment instructions, reminders, invoice, instructions on arriving at our base... In doing so, no promotional or marketing notifications come to your email address, unless you had explicitly requested so during the registration process.

d)     Where and for how long are data stored?

       These data are stored in our office computer and the booking management systems that we use. We shall delete your personal data upon termination of the contractual relationship or no later than these data are needed pursuant to any legal requirements.

        The data submitted to eVisitor are stored in their system for 10 years as specified in their Policy on Collection of Personal Data published here. Each unauthorized use, publication, change, processing, reproduction, distribution, recording or assignment or any other form of unauthorized use of such personal data is strictly prohibited. A complaint in regard to the processing of your personal data may be submitted by email to the Tourist Board of Split: This email address is being protected from spambots. e)      Who do we share data with?

        Apart from the data that we are obliged to submit in the Croatian National Tourist Information System – eVisitor, we use third-party booking management systems, which will not use your data for any purpose and will only keep the data in line with our policy on data retention. 4. Newsletter

a)     Which personal data are collected?

In case you have given us your consent to receive notifications about our promotional activities, you will share your email address with us. 

b)     What do we use data for?

To send you our marketing campaigns to inform you occasionally about changes in our offer, special rates, upgraded information...and to provide you with all the information about the growth of our site

c)      Where and how long are data stored?

These data are stored on the server of our web – hosting service provider for as long as you don't unsubscribe from our newsletter list by clicking the unsubscribe button in one of the newsletters or by sending us an email on This email address is being protected from spambots. d)     Who do we share data with?

We use a third-party web – hosting service provider, CloudAccess.net, As a Data Processor, CloudAccess.net  provided a data processing agreement which is available here.

 

5. Add Words, Facebook and Instagram

Due to the fact that we use Ad Words, Facebook and Instagram advertising services there are tracking codes installed on our website so that we can manage the effectiveness of these campaigns. We do not store any personal data within this type of tracking.

 

6. Credit card payment safety

When paying online on our web page you are using WSPay for online payments (https://www.wspay.info/), WSPay is a secure online payment system, real-time payments, credit and debit cards, and other payment methods. The WSPay customer and the merchant ensure secure enrollment and transfer of the tab data entered, as well as the PCI DSS certificate that WSPay has. WSPay uses 256-bit encryption SSL certificate and TLS 1.2 cryptographic protocol as the highest degree of data protection and data security..

7. Conversion Statement

All payments will be made in Croatian currency. The amount your credit card account will be charged with is obtained through the conversion of the price in Euro into Croatian Kuna according to the current exchange rate of the Croatian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion, there is a possibility of a slight difference from the original price stated on our website or in the contract.

 

8. Security of collected information

The company Fair wind d.o.o. gives a great importance to this statement and we think that the credibility of our business depends on the fact to which extent the company's activity is in accordance with this statement. Therefore, Fair wind d.o.o. takes special care that collected information about the user are safe and protected from loss, changes, unauthorized access or any kind of misuse.

We are not going to use collected information for purposes that are not mentioned in this statement unless it is necessary for the procedure of the realization of the selected service.

The company Fair wind d.o.o. does not sell, trade, rent or give your personal data to third parties except in the following cases:

– If you explicitly and in writing agree to disclose certain confidential data for a particular purpose or to a particular person.

– If the Ministry of the Interior or the competent State Attorney’s Office requires the data for the purposes of carrying out the tasks within their competence.

– If a court, attorneys or a notary public require the data for their proceedings, where the submission of such data is required in writing.

– If the Tax Administration, the Croatian Pension Insurance Institute, and Croatian Health Insurance Institute require the data on the basis of legal obligations that the controller has towards them.

– If we are obliged to submit data to the Ministry of the Sea, Transport and Infrastructure and the Ministry of Tourism.

 

9. Accessing and updating your personal data
